During a general mobilization, certain categories of citizens are entitled to a deferment from conscription. This applies to men who provide permanent care for an individual.

Who is eligible for care and how to arrange it, explained lawyers from Bachinsky and Partners. The following individuals require care, whether professional or non-professional:

  • people with disabilities of the first group;
  • children with disabilities;
  • elderly individuals with cognitive impairments;
  • those with incurable diseases who, due to bodily function impairments, cannot move or care for themselves independently;
  • seriously ill children who have not yet been assigned a disability status.

Documents Required for Care Arrangement

To arrange for permanent care, you need to submit the following document package to social protection authorities or the CNAP:

  • a statement of consent to provide social care services on a non-professional basis;
  • a statement of consent to receive social services;
  • information about income and property status;
  • a copy of the certificate from the medical and social expert commission or a copy of the conclusion from the LCC;
  • passports and identification codes.

"If a capable individual who understands their actions requires care due to health conditions, mandatory consent for receiving care is necessary. Therefore, when it concerns an elderly person/pensioner with cognitive impairments, they must also submit a request to appoint someone who will provide them with permanent care,” the lawyers note.

Forms for these documents can be obtained from the local social protection authority.

Permanent Care

Permanent care can be provided for the following categories:

  • individuals with disabilities since childhood or of the first group;
  • people aged 80 and over;
  • individuals with severe mental illnesses and first or second group disabilities;
  • elderly citizens and people with disabilities who are unable to care for themselves.

Deferment and Traveling Abroad

Caregivers are entitled to a deferment from mobilization. To arrange this, one must apply to the TCK and SP with a statement and documents confirming their right.

After that, the commission must review your application and make a decision. If the result is positive, the TCK should issue a deferment certificate.

The caregiver may also travel abroad, but only if they have an official deferment from mobilization.
