During the state of martial law and mobilization, territorial recruitment and social support centers (TRC and SSP) have intensified their search for men who violate military registration rules. This pertains to citizens aged 25 to 60 who fail to fulfill their obligations as mandated by law.

As explained by legal experts, the TRC initiates the search, but the primary objective is not criminal prosecution, but rather to ensure that these individuals personally report to local centers. This is necessary for drafting a protocol on administrative offenses and imposing fines.

Reasons for the Search

Men are most often sought for the following reasons:

  • they are not registered for military service at their place of residence;
  • they are not registered at their workplace or educational institution;
  • they ignore the delivery of summons in person, by mail, or to their employer;
  • they refuse to undergo the military medical commission (MMC);
  • they have not updated their military registration data;
  • they evade being registered for military service;
  • they are avoiding mobilization.

The legal basis for such measures are violations defined by articles 210 and 210-1 of the Code of Ukraine on Administrative Offenses (CUPA).

What Happens After a Violator is Found

Once a violation is established, the TRC may contact the police to request the administrative detention of the conscript. The process then proceeds as follows:

  1. The violator is taken to the district TRC.
  2. A protocol on the administrative offense is drawn up.
  3. A ruling on the fine and administrative liability is issued.
  4. If there are no grounds for deferral, the violator may be sent for the MMC for subsequent conscription.

Experts add that conscripts who are wanted cannot be exempted from mobilization, and men abroad risk being denied the issuance of passport documents.

How to Remove a Search

Lawyers note that a search can only be lifted after a personal appearance at the TRC and the issuance of a ruling on administrative liability. The legislation does not provide for remote resolution of this issue.
