The Cabinet of Ministers of Ukraine has published resolution No. 1332, introducing new requirements for confirming the critical status of enterprises to maintain the reservation status of their employees. According to the document, enterprises with critical status must validate their criticality by February 28, 2025.
As per the updated requirements, state and municipal enterprises, as well as those with a state share exceeding 50%, must meet the average salary criterion, which should be higher than the average salary in the region for the fourth quarter of 2021. For other enterprises, the minimum threshold for the average salary is set at 2.5 minimum wages, or 20,000 UAH per month. Additionally, for employees applying for reservation, their salary must meet this threshold for at least one month of the last quarter.
A significant new provision is the possibility of revoking the reservation if an employee's salary falls below 2.5 minimum wages during the last reporting quarter.
The government also noted that within 10 days of the resolution's adoption, ministries and regional state administrations must review the criteria for determining critical enterprises, coordinating them with the Ministry of Economy and the Ministry of Defense. Ministries and agencies will have three months to reassess all previously issued critical enterprise statuses.
Once the status is confirmed, the enterprise can submit a new application for the reservation of its employees through the "Diia" portal, and the reservation must be processed within 72 hours.
The updated procedure also allows for the reservation of employees in critical infrastructure enterprises, such as the energy sector and emergency recovery teams of telecommunications operators approved by the Ministry of Digital Transformation. At the same time, contractors and enterprises servicing life support systems have been excluded from the list.
The total number of reserved workers in Ukraine is approximately 850,000, employed across 20,000 companies.
Previously, "Judicial and Legal Newspaper" wrote that the Cabinet of Ministers altered the reservation criteria—there will be a monthly review, and the private sector requires "white" salaries of 20,000 UAH.
