The Supreme Court has published a review of judicial practice regarding court costs in commercial and civil proceedings. The decisions were added to the Unified State Register of Court Decisions from 2018 to August 2024.
The review includes an analysis of judicial rulings and legal positions of the Supreme Court that shape the current approach to the application of norms related to court costs, their distribution among parties, and reimbursement, as well as key trends observed in resolving disputes over court costs, specifically:
- determination of court fees for filing property-related claims;
- court fees for submitting appeals and cassation complaints;
- application of provisions from Articles 3 and 5 of the Law of Ukraine "On Court Fees" regarding exemption from payment of court fees for filing applications (complaints);
- application of provisions from Article 8 of the Law of Ukraine "On Court Fees" concerning deferral and installment payments of court fees, reduction of their amount, or exemption from payment;
- procedures for returning court fees;
- distribution of court costs when a claim is left without consideration or when the proceedings are closed;
- distribution of court costs based on the outcomes of cases involving a prosecutor;
- specifics of distributing costs for professional assistance.
