The Southeast Interregional Office of the State Labor Service has clarified when an employee is not required to return money for unused vacation days.

According to Article 127 of the Labor Code of Ukraine, deductions from an employee's salary to cover debts to the employer may be made by order or at the employer's discretion if the employee resigns before the end of the working year for which they have already received vacation pay for unused vacation days.

However, the Code also provides exceptions where deductions for these days are not applied.

This includes cases of being sent for training, retirement, and dismissal in the following situations:

  • call-up or enlistment in military service;
  • transfer to another enterprise, institution, or organization;
  • transition to an elected position;
  • refusal to relocate or continue working due to significant changes in working conditions;
  • changes in production organization;
  • incompatibility with the position due to health issues or insufficient qualifications;
  • absence from work for more than 4 months due to illness.
