The new Law of Ukraine "On Mandatory Insurance of Civil Liability of Owners of Land Vehicles" has modified and expanded the conditions under which a European protocol can be drawn up without the need to call the police. This was stated by the First Deputy Head of the Patrol Police Department Alexey Beloshitsky.
As reported by "Judicial and Legal Newspaper", the Cabinet of Ministers has amended the Road Traffic Rules, altering the grounds on which drivers involved in an accident can leave the scene without notifying the police.
"Vehicle drivers have the right to jointly create a notification about the accident for the insurer in paper or electronic form without involving police officers. After the notification is prepared, the drivers are allowed to leave the accident scene and are relieved of the obligation to inform the National Police about the accident," he specified.
When can an accident be documented without police involvement:
Alexey Beloshitsky notes that previously, the mandatory requirement for drawing up a European protocol was that the damage from the accident could not exceed 80,000 UAH, but starting from January 1, this limit has been abolished.
Furthermore, starting in 2025, the maximum insurance payout for property damage resulting from an accident will be increased to 250,000 UAH. For contracts concluded before 2025, the maximum payout amount is 160,000 UAH.
The digital service for documenting accidents will verify the data for accuracy and point out any errors. Information about the accident will be immediately sent to the insurance companies of both parties and entered into the MTSBU database.
