The Appeals Chamber of the VAKS examined the request to close the case regarding losses incurred during the construction of "Okhmatdet."

On January 28, the Appellate Chamber of the High Anti-Corruption Court reviewed the defense's request for exemption from criminal liability for two defendants in the case concerning damages incurred during the construction of "Okhmatdet," and the closure of the criminal proceedings due to the expiration of the statute of limitations. This information was reported by the press office of the High Anti-Corruption Court.

The panel of judges granted the request of the defendant's attorney and released her from criminal liability based on paragraph 4 of part 1 of Article 49 of the Criminal Code of Ukraine due to the expiration of the statute of limitations, and closed the criminal proceedings under paragraph 1 of part 2 of Article 284 of the Criminal Procedure Code of Ukraine, while the civil claim against the defendant was left without consideration.

The request from the attorney of another participant in the case, who declined to seek exemption from liability, was left unsatisfied by the panel of judges of the High Anti-Corruption Court, with the next court session scheduled for 1:00 PM on March 10.

The request was submitted as part of the consideration of the defense's appeals against the verdict of the High Anti-Corruption Court dated December 26, 2022. The first-instance court found the former head of the state enterprise "Ukrmedproekstroy" guilty of committing criminal offenses specified in part 2 of Article 28 and part 2 of Article 364 of the Criminal Code of Ukraine.

Her accomplice, the former director of "Ukrprofmed" LLC, was found guilty of committing criminal offenses outlined in part 5 of Article 27, part 2 of Article 28, and part 2 of Article 364 of the Criminal Code of Ukraine. Both defendants were exempted from punishment under part 1 of Article 366 of the Criminal Code of Ukraine due to the expiration of the statute of limitations in the criminal proceedings.
